The "fact of creation" in french literary and artistic property law
Le « fait de la création » en droit de la propriété littéraire et artistique : une proposition de lecture réaliste de l’article L. 111-2 du Code de la propriété intellectuelle
Résumé
The article L. 111-2 of the french Intellectual Property Code considers the “fact of creation” as the “fact of realization”
of the “conception of the author”. The “work of the mind” that results from it is the object of the author’s property but
is nonetheless an enigma for jurists (as creation has always been for philosophers and theoreticians of art). Without
claiming to settle this unfathomable question, this thesis proposes a prism to investigate its legal sense : realism. This
prism gives the “work of the mind” a causal analysis, an approach to the act of creation and more fundamentally a
reflection on the human mind.
The proposed reading offers some answers that renew those ordinarily brought to some debates on the subject (the
role of originality, notions of work, form and idea, the theory of the unity of art or even the role of the agent of the
realization). It also allows to deepen less usual questions (the importance of technical means, the question of
“accumulation of protections”, or the identification of theoretical and philosophical bases of the french literary and
artistic property law).
The realistic reading developed in this thesis remains a proposition but the conclusions it allows seem to answer
satisfactorily to many current issues ranging from the judicial motive of the qualification of “work of the mind” to the
questions posed by the “artificial intelligence”.
L’article L. 111-2 du Code de la propriété intellectuelle répute le « fait de la création » par le « fait de la réalisation » de
la « conception de l’auteur ». L’« oeuvre de l’esprit » qui en résulte est l’objet de la propriété incorporelle de l’auteur mais
n’en demeure pas moins une énigme pour les juristes (ainsi que l’a toujours été la création pour les philosophes et les
théoriciens de l’art). Sans prétendre régler cette insondable question, cette thèse propose un prisme de lecture à son
acception juridique : le réalisme. Ce prisme fournit à l’« oeuvre de l’esprit » une analyse causaliste, une approche de l’acte
créatif et plus fondamentalement une réflexion sur l’esprit.
La lecture proposée offre quelques réponses qui renouvellent celles ordinairement apportées à quelques débats de la
matière (le rôle de l’originalité, les notions d’oeuvre, de forme et d’idée, la théorie de l’unité de l’art ou encore le rôle de
l’agent de la réalisation). Il permet aussi d’approfondir des questions moins habituelles (l’importance du moyen technique,
la question des « cumuls de protections », ou encore l’identification des fondements théoriques et philosophiques du droit
de la propriété littéraire et artistique).
La lecture réaliste développée dans cette thèse reste une proposition mais les conclusions qu’elle permet semblent
répondre de manière satisfaisante à de nombreux enjeux actuels allant de la motivation judiciaire de la qualification
d’« oeuvre de l’esprit » aux questions posées par l’« intelligence artificielle ».
