"Is the duality of working languages a source of conflict or mutual enrichment? The Example of the Cape Town Convention and Its Protocols"

Résumé

Is the existence of several language versions of the same international treaty an opportunity or a curse? As the richness and subtleties specific to each language make any perfect equivalence of the different versions of the text illusory, differences in wording or even meaning invariably exist and constitute inexhaustible sources of discussion between lawyers. However, provided that priority is given to the parallel drafting of each of these versions in each working language by a bilingual drafting committee, and not a simple translation of a matrix – English – version into the other languages, it is possible to see in this diversity a source of enrichment for interpreters, whether judges or practitioners. The comparison of the English and French versions of the Cape Town Convention and its protocols gives a perfect example of this mutual enrichment.
