The impact study in heritage matters: a trompe l'oeil reference system?
L'étude d'impact en matière patrimoniale: un référentiel en trompe l'oeil ?
Résumé
From a proceedural point of view, the study includes, for each of the devices, skills due to the regulatory
governance. From a substantial point of view, the steering of this « hybrid » public policy
goes beyond the public sphere. The induced effects on the economy of culture trough
such governance should have been sytematized from artistic creation to cultural heritage. If the culture of the result seems to be erased in the framework of the cost-benefit balance,
thus affecting the repository of this impact study, we must nonetheless emphasize the alternative proposals, suggested to some of these devices. A tool for informing and legitimizing
public action, the impact study thus restores the choices made, following a confrontation of
conflicting interests and as part of a mediator expertise. Finanlly, justified to improve the formal quality of the laws, the impact study must now report on public management according
to a cardinal principle of transparency.
D’un point de vue procédural, l’étude reprend pour chacun des dispositifs, une
trame conforme à la gouvernance réglementaire. D’un point de vue substantiel, le pilotage
de cette politique publique « hybride » déborde de la sphère publique. Les effets induits
sur l’économie de la culture par une telle gouvernance auraient dû être systématisés de la
création artistique au patrimoine culturel. Si la culture du résultat semble effacée dans le
cadre du bilan coûts-avantages, affectant ainsi le référentiel de cette étude d’impact; il faut
néanmoins souligner les propositions alternatives suggérées à certains de ces dispositifs.
Outil d’information et de légitimation de l’action publique, l’étude d’impact restitue ainsi les
choix opérés, à l’issue d’une confrontation d’intérêts contradictoires et dans le cadre d’une
expertise « médiatrice ». Somme toute, justifiée pour améliorer la qualité formelle des lois,
l’étude d’impact doit désormais rendre compte de la gestion publique selon un principe
cardinal de transparence.
