La motivation des arrêts de la Cour de cassation et le justiciable
Résumé
A reflection committee was formed at the Cour de cassation whose goal is to formulate a number of reform proposals. One of the questions at stake regards the way in which the High Court motivates its decisions. In light
of the way in which the motivation is generally presented and given the recent transformations of the legal system, the person answerable to the law could be placed back at the heart of the preoccupations. This proposal can be justified in consideration of both the creating role of the Cour de cassation and its status of jurisdiction. This proposal could be achieved through concrete changes in the mode of redaction of decisions.
