The progressive emergence of a subjective right to a healthy environment in international human rights law
L’émergence progressive d’un droit subjectif à l’environnement sain en droit international des droits de l’Homme
Résumé
The main objective of this article is to discuss if, especially after the adoption by the general assembly of the United Nations the 28th of July 2022 proclaming that it "Recognizes the right to a clean, healthy and sustainable environment as a human righ", this right became a subjective right in the international order. That would suppose that it is actually offered to a wellidentified beneficiary, in this case the individual, and that it at the same time sends a legal obligation to respect it, by taking the necessary measures to achieve it, to a recipient of the obligation, in occurrence the State. In this regard, two phenomena must be observed: on the one hand, we note that even though some systems still refute the autonomous existence of such a right, they clearly adress positive obligations to respect it, through the caselaw of their organs of protection, to the States parties ; on the other hand, some systems, such as the interamerican one, decided to regognise the exitence of an autonomous right to a healthy environment, either trough the case-law of their organs, either directly in the instruments of protection.
L'objectif principal de cet article est de se demander si, suite à l'affirmation de l'assemblée générale des Nations Unies le 28 juillet 2022 en vertu de laquelle « l'accès à un environnement propre, sain et durable fait partie des droits humains », ce droit est désormais reconnu comme un droit subjectif dans l'ordre juridique international. Cela supposerait d'identifier clairement un bénéficiaire de ce droit, à savoir l'individu, et un destinataire de l'obligation y afférente, en l’occurrence l'Etat. Deux phénomènes peuvent être observés: d'un côté, bien que certains systèmes de protection refusent
toujours de reconnaitre son autonomisation, leurs organes de contrôle reconnaissent malgré tout des obligations positives claires à la charge des
Etats parties ; de l'autre côté, certains systèmes régionaux, tel le système
interaméricain, ont décidé d'aller plus loin en consacrant un véritable droit
subjectif, soit à travers la jurisprudence, soit directement dans l'instrument
de protection concerné.
