Du bon usage par la BCE de son pouvoir discrétionnaire en matière prudentielle

Résumé

In its 13 of July judgment, the General Court annuls ECB decisions concerning the calculation of the leverage ratio of French banks. The Basel III agreement and the transposing EU legislation introduce the “leverage ratio” as a simple pruden- tial tool. Some banks, especially French ones, obtained a derogation for some spe- cific investments. The ECB denied six French banks the benefit of this derogation. They seek the annulment of the ECB’s decisions. The General Court examines the specificity of the leverage ratio, and its objective. Although it is a new prudential tool, it is included in a more global environment. So, the ECB needs to integrate the leverage ratio and its objective into the objective of the derogation and the li- quidity ratio. The General Court recognizes that the wording of the derogation give the ECB discretion to grant it. But, the appreciation of the ECB needs to be coher- ent with the global environment, which it is not, so the Court annuls its decisions.
