La gouvernance du risque climatique : aspects juridiques d’une « tragédie des horizons »
Résumé
Policies to combat global warming are an essential lever in the fight against the weakening of our social, economic and financial system. The law makes it possible to provide the tools, the means and the control of their implementation. The law provides decision-makers and actors with instruments to better manage and anticipate these risks. These different tools must identify the existence of climate risks. These risks are complex, poorly identified, poorly known, insufficiently evaluated, partially treated, and poorly recognized by the actors. This makes it difficult to deal with them and to establish a coherent mode of governance for the legal instability that they can generate. This article summarizes the report submitted to ADEME on 4 April 2022 by the FinClimLex research group. It presents the levers that already exist to identify the risks and to better govern them, while pointing out the gaps and difficulties. This study also proposes points of vigilance and recommendations in the form of avenues to be explored in the future.
