Protection des droits fondamentaux et Brexit: les délicates questions soulevées par l’affaire Minister of Justice v. O’Connor
Résumé
How can we ensure that a citizen of the Union, which is detained in UK after the Brexit, may benefit from rights conferred by the Charter of undamental Rights of the European Union? The Court of Justice of the European Union will have to answer to this thorny question raised for a preliminary ruling by the Irish Supreme Court. The future judgment will bring to the forefront the importance of human rights in the negotiation between the EU and the UK.
Comment s’assurer qu’un citoyen de l’Union, incarcéré au Royaume-Uni après le Brexit, puisse bénéficier des droits qui lui sont conférés par la Charte des droits fondamentaux de l’UE ? La Cour de justice de l’Union européenne va devoir répondre à cette question épineuse soulevée dans le cadre d’un renvoi préjudiciel effectué par la Cour Suprême d’Irlande. Cet arrêt permettra de mettre en avant l’importance des droits fondamentaux dans les négociations entre l’UE et les Britanniques.
