La redéfinition des relations entre l’Union européenne et le Royaume-Uni : les modèles de coopération envisageables
Résumé
According to Article 50 paragraph 2 TFEU, the European Union shall
negotiate the withdrawal agreement with a Member State “taking account of the framework for its future relationship with the Union.”
Even if, so far, one doesn’t know much about what such a framework could be, one can wonder if pre-existing models of the EU’s External agreements could inspire the future EU-UK relationship. For political reasons, both the EU and the UK might however seek an ad hoc partnership. In this perspective, pre-existing external agreements could certainly be used more as toolboxes than as models. They indeed offer a diversity of legal instruments that could be combined in a new way to match the level of disintegration that both the EU and the UK tend to establish after Brexit.
