The French Constitution and the European Constitution : Towards a convergence of the various legal systems ? Some thoughts on the constitutional amendement of February 28, 2005.
The French constituent authority has recently included the principle of the "European Constitution" in its basic text; This constitutional "first" will necessarily lead to a convergence of the various legal systems. National sovereignty is becoming "Europeanised" via the participation of the people ant their representatives in European political power, and through the use of state-like powers by the European institutions. Each national institutions, each European institution and each people has now become a participant in a constitutional process the likes of fwhich has never been seen. The French Constitution is influenced by a Europe which is itself included within in the constitutionnal perimeter. It is now down to the peoples' governing powers and judgls no shape this constitutional interface and this gradual convergence of legal systems, if the European Constitution is finally adopted by the various peoples and nations of Europe.

Le pouvoir constituant français vient d'inscrire dans le texte fondamental le principe de la "Constitution européenne". Cette primeur constitutionnelle conduit nécessairement à une osmose des ordres juridiques. La souveraineté nationale s'européanise par la participation du peuple et de ses représentants au pouvoir politique européen, par l'exercice de pouvoirs régaliens par les institutions européennes. Chaque institution nationale, comme européenne, chaque peuple devient désormais partie prenante d'un objet constitutionnel inédit. La Constitution française se teinte d'une Europe qui elle-même entre dans le champ constitutionnel. Il reviendra aux peuples, gouvernants et juges à penser cette rencontre et cette osmose progressive des ordres juridiques, si la Constitution européenne est souverainement adoptée par les peuples et nations.
