La réparation dans la pratique de la Cour internationale de Justice

Résumé

The practice of the International Court of Justice with regard to reparations has been reviving for a dozen years. Three judgments on compensation were delivered in very different contexts, whereas the ICJ had previously delivered only one, in 1949. Those judgments, without calling into question previous case-law, show a significant development in the treatment of claims for compensation. The Court seems to have moved away from an overly rigid assessment of the conditions for compensation. It now demonstrates a degree of flexibility and adaptability that allows it, depending on the context and complexity of each case, to modulate the standard of proof of injury, and the causal link between the wrongful international act and the injury. It also takes into account “equitable considerations” in determining the amount of compensation. This change makes it possible to give concrete priority to the objective of reparation over the strict requirements of the law of international responsibility and thus responds to a need for justice.
