              <p>There are two main types of transnational administrative situations in environmental matters: those concerning the prevention and/or remediation of transboundary environmental damage, on the one hand, and those aimed at the unified management of transboundary natural environments or ecosystems, on the other. The former has led to the development of a kind of ‘minimal’ transnational law centred on the transboundary environmental assessment procedure. This procedure requires the extraterritorial effects of administrative acts in environmental matters to be taken into account and provides for the exchange of information between national administrations and consultation with the foreign public. In addition to this minimal law, there may also be sectoral rules on cross-border cooperation for the unified management of certain environments. Sectoral cross-border cooperation is particularly developed in water law and nature conservation law. It only takes over for mechanisms that exceed the scope and reach of horizontal law, such as transboundary environmental assessments.&lt;br/&gt;While these two types of transnational administrative situations can theoretically give rise to disputes, those that do arise are essentially of an extra-contractual nature. They can therefore be linked to the first type of transnational administrative situation, where damage prevention has failed and compensation arrangements must be considered. These disputes, including the emblematic case of the ‘Alsace potash mines’, are largely guided by the principles of non-discrimination (of victims and the effects of cross-border pollution) and equal access (to administrative and judicial procedures). The existence of these principles, combined with the central role played by transboundary environmental assessment, raises questions about the possibility that a ‘transnational common law’ on the environment may be emerging.</p>

              <p>Il existe principalement deux types de situations administratives transnationales en matière environnementale : celles qui concernent la prévention et/ou la réparation de dommages environnementaux transfrontières, d’une part, et celles qui visent à la gestion unitaire de milieux naturels ou d’écosystèmes transfrontaliers, d’autre part. Le premier a mené à la construction d’une sorte de droit transnational « minimal » canalisé autour de la procédure d’évaluation environnementale transfrontière. Cette procédure suppose la prise en compte des effets extra-territoriaux des actes administratifs en matière environnementale, et organise un échange d’informations entre administrations nationales ainsi qu’une consultation du public étranger. À ce droit minimal, s’additionnent éventuellement des règles sectorielles de coopération transfrontalière pour la gestion unitaire de certains milieux. La coopération transfrontalière sectorielle se développe particulièrement en droit de l’eau et en droit de la conservation de la nature. Elle ne prend le relais que pour les mécanismes qui excèdent l’objet et la portée du droit horizontal que constitue celui des évaluations environnementales transfrontières.&lt;br/&gt;Si ces deux types de situations administratives transnationales peuvent théoriquement donner lieu à des contentieux, ceux qui se développent comportent essentiellement une dimension extra-contractuelle. Ils sont ainsi rattachables au premier type de situation administrative transnationale, lorsque la prévention des dommages a échoué et qu’il faut envisager les modalités de la réparation. Ces contentieux, dont l’affaire emblématique des « Mines de potasse d’Alsace », sont largement guidés par les principes de non-discrimination (des victimes et des effets des pollutions transfrontières) et d’égalité d’accès (aux procédures administratives et juridictionnelles). L’existence de ces principes, associée à la place centrale qu’occupe l’évaluation environnementale transfrontière, interrogent sur l’éventualité qu’un « droit commun transnational » environnemental serait en train d’émerger.</p>
