Style and Form of Judgments in France : enter the Rapporteur public
Résumé
This chapter examines the style and form of judicial decision-making in France, focussing on the approach of the French administrative courts. Whilst it is traditionally argued that the French approach to judgments is highly formalistic, it is important to set this within a broader context. Similarly to work on French private law courts, it is argued here that there is compelling evidence that behind the terse decisions of the French administrative courts, more discursive aspects can be detected including also the use of broad policy factors.
