Le Livre IX de la Recopilación de Leyes de las Indias entre souveraineté commerciale et droit « proto-colonial »
Abstract
The book IX of the Recopilación de Leyes de las Indias (1680) is specifically devoted to the organisation of trade with the Spanish Indias. It is an extremely complex and yet illuminating book, both with regard to trade within these territories and to “external” trade relations. From a “pre-state” perspective, this book IX is a valuable reading key, since the political-institutional construction of the state in the Indias is, in fact, immersed in a context of long-distance trade that preceded and formed the legal-administrative instruments of organisation and government of the Spanish overseas territories.
