Résumé
The obligation to produce ex novo evidence is justified by the effectiveness of private enforcement of competition law infringements. The Court of Justice takes the opportunity to recall the principle of freedom of evidence and the role of the judge in assessing the relevance of the production of evidence. The national jurisdiction is required to exercise strict judicial review and to balance the various interests in order to preserve the balanced nature of the evidence in actions for damages.
