Liberté religieuse, abattages rituels, agriculture biologique et « bien‑être » animal : une quadrature du cercle éthique et juridique. CJUE, gde ch., 26 février 2019, Œuvre d’assistance aux bêtes d’abattoirs, aff. C‑497/17
Résumé
Animal “Welfareˮ – Organic Farming – Ritual Slaughterings – Freedom of Religion In a judgment Œuvre d’assistance aux bêtes d’abattoirs (OABA), of 26 February 2019, the Court of Justice of the European Union ruled that the European logo “or- ganic farming” cannot be affixed to meat from ritual slaughter without prior stunning. This decision is based on a teleological interpretation of European regulations which aims to promote animal “welfare” in organic farming. It also revives the debate on the right balance between the objectives – at the very least divergent – of protecting animal “welfare” and respecting religious rites in slaughter
