Reflections on the Continuous Application of “Foreign Law” in Former West Cameroon
Réflexions sur l’application continue du « droit étranger » dans l’Ex-Cameroun Occidental
Résumé
Cameroon is a decentralised unitary State under legal federalism with several systems of laws applying. Among which are the Common Law and the Civil Law systems, derived from England and France, and applied in two separate portions of the territory: Former West and Former East Cameroon. While in Former East Cameroon, reception of French law froze upon independence, in Former West Cameroon, an enabling instrument warrants the continuous reception and application of English laws as soon as they are enacted in England so long as Cameroonian Parliament has not legislated on the issues. Its implementation raises questions as to its conformity with the Cameroonian Constitution. This paper aims at clarifying the grounds for the continuous reception and application of foreign laws in Former West Cameroon, the challenges posed and the possible alternatives to such a state of affairs.
Le Cameroun est un Etat unitaire décentralisé sous fédéralisme juridique avec plusieurs systèmes juridiques. Parmi ceux-ci, le droit civil et la « Common Law » provenant de la France et de l’Angleterre qui s’appliquent sur deux parties différentes du territoire : l’Ex-Cameroun Oriental et l’Ex-Cameroun Occidental. Alors que dans l’Ex-Cameroun Oriental la réception du droit français fut gelée dès l’indépendance, dans l’Ex-Cameroun Occidental, un texte permet la réception et l’application continues de lois anglaises dès lors qu’elles sont adoptées en Angleterre tant que le parlement camerounais n’a pas légiféré sur la question. La conformité de ce texte avec la constitution camerounaise pose débat. Cet article vise à apporter des clarifications sur les bases de la réception et de l’application continues du droit étranger dans l’Ex-Cameroun Occidental, les défis que cela pose et les alternatives possibles.
