Remedies and Remedial Dynamics in Climate Change Litigation: Opportunities and Challenges

Résumé

This chapter focuses on what plaintiffs want when bringing climate change litigation to courts. They seek a wide range of remedies: some of them are in the field of Law, while others are more political, even strategic. This does not mean, however, that the two, in the end, can come together and allow for greater effectiveness in the fight against climate change. But for greater clarity in our presentation and analysis, we will create an ad hoc typology that takes into account this first dychotomy.
