Climate Change Litigation and legitimacy of judges towards a « wicked problem »: Empowerement, discretion and prudence

Résumé

For the past ten years climate litigation has received growing attention from academics, lawyers and civil society. Although the first climate trials emerged twenty years ago, they have recently increased and constitute nowadays a new trend in international, administrative and civil law. While climate litigation has acquired interest as a relatively new procedural and judicial phenomenon, the contribution that judges make to the construction and implementation of ecological transition in the context of the climate crisis has become an object of studies in itself. This article belongs to the latter category of studies in that it explores the role of the judge in the context of climate litigation and presents both its possibilities and limits, while also highlighting the progress that has been made in this area.
