Résumé
The current absence of climate jurisprudence in European Union law and the difficulties experienced by the European Court of Human Rights in asserting an autonomous right to the environment are obstacles to advancing climate justice in Europe. While climate litigation is multiplying throughout the continent and in France, it is at the national level that the greatest developments are taking place, for the moment. The recent publication of the Strasbourg "doctrinal" principles could help climate justice and produce an impetus for climate action at the European and national levels, particularly in France with the Carême case, following on from the Grande Synthe decisions.
