Narratives about “Legislator” in the Mutation of French Civil Law Doctrines(1880s—1940s)

法国民法学说演进中对立法者认识的变迁

Résumé

The relation between legislative power and judicial power was one of the prevailing subjects in the domain of civil law in late 19th and early 20th century France. By examining the narratives about legislator in the works of François Gény, Emmanuel Lévy and Georges Riper, this article concludes that their positions regarding legislation in its relation to the judiciary are products of the interactions between the particular authors and their contexts. For Gény, despite the innovative feature of his method of legal interpretation, method of this conservative liberalist is designed to refuse progressive legislations. In the scope of the legal socialism of Lévy, on contrary, legislative power serves as the major means to grant the demands of working class the status of law, which finally rooted in his confidence of democratic regime. Ripert shares neither the commitment to democracy with Lévy, nor that to justice with Gény. He argues that the guideline of interpretation lies on the Christian morality embodied by law, and democracy would finally destroy such morality.
第三共和国时期的法国法学界,立法与司法在制度变迁中的关系一直是一个重要的主题。本文选择惹尼、莱维、里佩尔三位法学家对立法者的论述,管窥他们所处时代的关切是如何形塑他们的学说。基于三位法学家所处的具体历史环境,他们的理论呈现出不同的面貌。惹尼在其法律解释理论具体阐述中,透过方法论的革新实现拒斥进步主义立法的目的。莱维的法律社会主义则相信民主制下的立法权将用以实现支配性的社会意识,并对现代社会立法渐增持乐观态度。里佩尔的法律实证主义并不是要把法律和道德分离,而是致力于维护法律中所体现的道德。在他看来,民主政府的立法将会威胁到体现在旧有民法中的基督教道德。
