Sale of food products without packaging: the consumer as a key player in food safety

Résumé

In France, the practice of selling in bulk has existed for many years mainly for dry products (cereals, pulses, or dried fruit). However, the variety of products is increasing, encouraged by societal demand and by the French legislation with the anti-waste law for a circular economy. ANSES (French Agency for Food, Environmental and Occupational Health & Safety) has been asked by the French authorities to identify products that cannot be sold in bulk for public health reasons. Any consumer product has been considered, including food, taking into account microbiological, chemical, and physical hazards. An expert opinion has been published, based on a draft regulation. It was supported by the study of the regulation, the previous scientific opinions (EFSA or ANSES), and the consultation of public health experts and researchers. For food, the focus was on certain products, such as microbiologically perishable or frozen products, but also on the identification of new practices that could lead to food contamination such as the bringing of a container by the consumer. To avoid food poisoning, the consumer should follow hygienic practices during the preparation, cooking or storage of foods. Bulk sales reinforce the need for the consumer to play a greater role in food safety. Certain mandatory information for pre-packaged products should be provided to consumers of bulk products. For microbiological hazards, this concerns, for example, shelf life (‘Use by’ or ‘best before’ date), instructions for use (e.g cooking time) or any information to facilitate product recall procedures. When the consumer brings its own packaging, attention should be paid to its hygiene and visual check is not a guarantee of safety. ANSES emphasizes the need to strengthen communication to inform and support French consumers in the implementation of good practices associated with these new trends in bulk sales.
