The juridical status of the actor in medieval canon law

Résumé
In the study of the relationship between the Church and theatre, the analysis of legal writings, too often kept in the shadow of theology, has not received the attention that it deserves. Thus, we have undertaken an examination of the canonical documentation (both in theory and in practice) and we propose here the initial results concerning the actors and their status in the Middle Ages. Whereas Molière’s excommunication is still considered representative of medieval practices, we will see that on the one hand it cannot be viewed as a typical case, and on the other hand it must not make us forget another penalty : infamy. We took advantage of this survey to study the way the actor is defined by jurists, especially in glosses.
Dans l’étude des rapports entre l’Église et le théâtre, l’analyse des écrits juridiques, trop souvent dans l’ombre de celle de la théologie, n’a pas eu la place qu’elle mérite. Nous avons donc entrepris une étude de la documentation canonique, à la fois théorique et pratique, dont nous proposons ici les premiers résultats concernant l’acteur et son statut au Moyen Âge. Si le cas de l’excommunication de Molière est dans bien des esprits, d’une part il ne peut pas être généralisé, d’autre part il ne doit pas faire oublier l’existence d’une autre peine : l’infamie. Nous avons par ailleurs profité de cette enquête pour étudier la manière dont l’acteur se trouve défini par les juristes, notamment dans des gloses.
