Medical cannabis: thinking out of the box of the healthcare system

Résumé

France is about to experiment with legal access to medical cannabis. In this short contribution, we propose an analysis of this regulation choice in light of the intrinsic characteristics of medical cannabis and the lessons learned from other countries. More precisely, we argue that scientific evidence for the efficacy of cannabis is limited, which favors restrictive regulation schemes, similar to those found in other European countries. However, since there are strong technical and economic barriers to demonstrating the efficacy of medical cannabis, more accommodative regulatory frameworks such as those found in North America, have advantages, but these are also at risk of excessive or diverted use. In order to keep the best of both systems, it might be possible to design innovative regulatory frameworks based on a dual-distribution system for medical cannabis. Cannabis Social Clubs, for example, could serve as a distribution structure complementary to the conventional healthcare system.
La France est sur le point d’expérimenter l’accès légal au cannabis médical. Dans cette courte contribution, nous proposons d’analyser la réglementation choisie à la lumière des caractéristiques intrinsèques du cannabis médical et de certaines leçons tirées des expériences étrangères. Plus précisément, nous soutenons que les preuves scientifiques de l’efficacité du cannabis sont limitées, ce qui plaide en faveur de régimes de régulation restrictifs tels que ceux qui existent en Europe. Toutefois, dans la mesure où la démonstration de l’efficacité du cannabis rencontre des barrières techniques et économiques importantes, des cadres réglementaires plus souples, comme ceux d’Amérique du Nord, présentent des avantages, mais risquent également d’être utilisés de façon excessive ou détournée. Afin de conserver le meilleur des deux systèmes, il pourrait être possible de concevoir des cadres de régulation innovants fondés sur un système dual de distribution de cannabis médical. Les Clubs Sociaux Cannabiques pourraient par exemple servir de structure de distribution, complémentaire au système de santé conventionnel.
