French Memory Laws. For a Better Past

Abstract

This article offers a brief historical analysis of the so-called "memory laws" in France (1990-2017), taking into account the laws actually passed (the Gayssot law of 1990 on the repression of Holocaust denial, the Taubira law of 2001 on the memory of slavery, etc.) and the attempts to pass similar laws that were not successful (the one repressing the denial of the genocide of the Armenians or the various bills on the alleged "genocide" in the Vendée during the Revolution). The article also analyzes some of the polemics caused by this intervention of the legislator in the writing of the past. This text comes from a paper given at the workshop: "Memory Laws. Criminalizing Historical Narrative", organized by the Institute for the Study of Human Rights of Columbia University (New York), 27 & 28 October 2017.
Cet article propose une brève analyse historique sur les "lois mémorielles" en France (1990-2017), en tenant compte des lois effectivement votées (loi Gayssot de 1990 sur la répression du négationnisme, loi Taubira de 2001 sur la mémoire de l'esclavage, etc.) et des tentatives de lois similaires non abouties (celle réprimant la négation du génocide des Arméniens ou encore les diverses propositions de loi sur le prétendu "génocide" vendéen sous la Révolution). L'article analyse également certaines des polémiques suscitées par cette intervention du législateur dans l'écriture du passé. Ce texte est issu d'une communication donnée lors du workshop : "Memory Laws. Criminalizing Historical Narrative", organisé par l'Institute for the Study of Human Rights de l'Université Columbia (New York), les 27 et 28 octobre 2017.
