Cardinaux et droit canonique

Canonical legislation concerning the cardinals, their status as well as their duties for the Holy See's service, did not go, for a long time, through a systematic organization until the promulgation of the Canon Law Code (1983). Stable rules however, presided over the creation of cardinals and governed their status, even within the Sacred College and the three cardinals orders. Similarly, and despite significant inflections around the Second Vatican Council, canon law has since the second half of the sixteenth century determined functions in sede plena periods, including the action of cardinals leaders of the Roman Curia dicasteries, the cardinal protectors of religious institutes or that of cardinal legates. The canonical sources, normative or not, concerning the cardinals are abundant, though their value and authority are unequal. A further systematic investigation should be taken into consideration by legal historiography.
La législation canonique touchant aux cardinaux, à leur statut ainsi qu’aux fonctions qu’ils exercent au service du Saint-Siège est longtemps demeurée disparate, jusqu’à l’entrée en vigueur du Code de droit canonique de 1983. Des règles stables ont toutefois présidé à la création des cardinaux et ont régi leur statut, y compris au sein du Sacré Collège et de ses trois ordres cardinalices. De même, et malgré des inflexions d’importance autour du concile Vatican II, le droit canonique a depuis la seconde moitié du XVIe siècle encadré les fonctions des cardinaux sede plena, et notamment l’action des cardinaux chefs de dicastère de la Curie romaine, celle des cardinaux protecteurs d’instituts religieux ou encore celle des cardinaux légats. Les sources canoniques, normatives ou non, évoquant le cardinalat sont abondantes, quoique de valeur et d’autorité inégales, et méritent une exploration plus systématique de la part de l’historiographie juridique.
