Endoscopie d’un privilège : le committimus dans l’ancien droit
Abstract
At the dawn of the revolution the monarchy had not succeeded in rationalizing the course of civil justice in spite of a great many reformations. There are still numerous exceptions and jurisdictional privileges which disrupt the course of lawsuits and prevent the unification of the law. The ancestral committimus, which is still in effect, perfectly illustrates this failure and symbolizes the complex and deadly relationship between the monarchy and privileges. Yet, in the first half of the 14th century, when it was instituted, it contributed to the construction of the State and contributed to the common good. It aimed at favouring the service to the king when dispensing justice and thus, the service to the crown.
À l’aube de la Révolution, en dépit de réformations multiples, la monarchie a échoué à rationaliser le cours de la justice civile. De multiples exceptions et privilèges juridictionnels subsistent, perturbent le cours des procès et empêchent l’unification du droit. Encore en vigueur, l’ancestral committimus illustre parfaitement ce constat d’échec et symbolise la relation complexe et mortifère que la monarchie entretient avec le pluralisme juridique. Pourtant, au premier XIVe siècle, son instauration avait d’autres motifs. Elle participait de la construction de l’État et concourrait au bien commun : le committimus servait à favoriser en justice le service du roi, partant celui de la Couronne.
