Résumé
The question of dangerousness has taken on considerable importance in the criminal field over the last few decades, to the point of constituting a major factor in the reconfiguration of police and judicial practices and the execution of sentences. In view of this evolution, it is not surprising that, at the same time, dangerousness has also become an object of interrogation and elaboration in the legal sciences and doctrinal discussions. We have chosen to use this last path by focusing on the development of the doctrine known as "criminal enemy law", which is probably the most systematic attempt to establish a "criminal law of dangerousness".
La question de la dangerosité a pris au cours des dernières décennies une importance considérable dans le domaine pénal, au point de constituer un facteur de reconfiguration majeur des pratiques policières, judiciaires et d'exécution des peines. Au regard de cette évolution, il n' est pas surprenant que, concomitamment, la dangerosité soit également devenue un objet d'interrogation et d'élaboration dans les sciences juridiques et les discussions doctrinales. C' est cette dernière entrée que nous avons choisi d' emprunter en nous intéressant au développement de la doctrine dite « du droit pénal de l' ennemi », celle-ci constituant sans doute l' entreprise la plus systématique de fonder en théorie un « droit pénal de la dangerosité ».
