L'apport de la Charte des droits fondamentaux à la protection des données personnelles dans l’Union européenne
Résumé
The right to personal data protection enshrined in the European Union Charter of fundamental rights is often presented as one of the major contributions of this text to the personal data protection and, more widely, to the European protection of fundamental rights. However, the added value of this new right should not be overestimated compared to the “old” right of privacy which offer an effective protection under the jurisprudence of the European court of human rights. It appears finally that the real added value of the Charter to the personal data protection resides rather in the better visibility offered to this right.
