Article 76 [Legislative Initiative]

Résumé

This provision is a derogation of the Commission’s monopoly of legislative initiative and also puts an end to the initiative by a single MS in order to prevent unilateral national actions. On the other side, MSs still have the opportunity to conduct coordinated initiatives in the area that is especially sensitive to national sovereignty. Initiatives of MSs require a reinforced qualified majority of 72% (Article 238.2 TFEU) in order to prevent the domination of special interests of certain MSs. Indeed, larger MSs cannot jointly override smaller MSs.
